The Little Green Bag is a fashion platform with a wide range of clothing, shoes, bags, accessories and lifestyle items for women, men and children. With an online webshop and a physical store in Delft, we offer our customers a unique shopping experience where style, quality and service are central.

Through our webshop, customers can order their favorite items 24/7, benefit from fast delivery, easy returns and our loyalty program 'Baggies'.

The general terms and conditions below apply to all products and services that The Little Green Bag offers through its webshop and stores, and to every agreement that is concluded with us. By using our webshop or placing an order, you agree to these conditions.

Article 1 Definitions:

General terms and conditions: these general terms and conditions of The Little Green Bag that apply to the Agreement.

Cooling-off period: The period within which the consumer can make use of the right of withdrawal.

Consumer: The natural person who does not act in the exercise of a profession or business and enters into an agreement with The Little Green Bag.

Day: Calendar day.

Durable data carrier: Any tool that enables the consumer or entrepreneur to store information in a way that allows future consultation and unaltered reproduction, such as e-mail or PDF.

Right of withdrawal: The possibility for the consumer to withdraw from the agreement within the cooling-off period.

Agreement: The distance contract or purchase agreement that is concluded between the consumer and The Little Green Bag via the webshop, physical stores or another sales channel.

Product: Any movable property, such as clothing, shoes, bags, jewelry, lifestyle items or other items, that is offered by The Little Green Bag. Remote communication technology: Means that can be used to conclude an agreement without the consumer and entrepreneur being physically present at the same time, such as via e-mail or the webshop.

Article 3 Applicability

1. These general terms and conditions apply to every offer from The Little Green Bag, every order via the webshop and every agreement that is concluded between the consumer and The Little Green Bag, regardless of whether this takes place online or in a physical store.

2. Before an agreement is concluded, the text of these general terms and conditions will be made available to the consumer in a clear and accessible manner. If this is not reasonably possible, The Little Green Bag will indicate before concluding the agreement where the general terms and conditions can be consulted and that they will be sent free of charge upon request. The consumer must actively agree to the general terms and conditions before completing the order.

3. If the agreement is concluded electronically, the general terms and conditions will be made available electronically in such a way that they can be easily stored on a durable data carrier, such as an e-mail or PDF download. If this is not possible, it will be indicated how they can still be obtained free of charge.

4. The Little Green Bag may change or supplement these terms and conditions at any time. The version that was valid at the time of purchase will always apply to current agreements, unless the consumer has expressly agreed to an amended version.

5. If, in addition to these general terms and conditions, specific product or service conditions also apply, then in the event of a conflict the provision that is most favourable to the consumer will apply, unless explicitly agreed otherwise. 6. If any provision of these terms and conditions proves to be invalid or unenforceable in whole or in part, the remaining provisions shall remain in full force. In that case, the provision in question shall be replaced by a provision that, in terms of content and scope, comes as close as possible to the purpose of the original provision.

Article 4 Offer & Agreement

1. All offers and price indications of The Little Green Bag are without obligation and subject to availability, errors or changes. Obvious mistakes, typing errors or technical errors in prices, images or product information do not entitle to delivery or compensation.

2. The Little Green Bag strives for a presentation of its range that is as complete and accurate as possible. Images, colours and descriptions on the website are illustrative and may differ slightly in reality. The consumer cannot derive any rights from this.

3. An agreement is concluded as soon as the consumer has placed an order and this has been confirmed by The Little Green Bag by e-mail. As long as the receipt of this acceptance has not been confirmed by The Little Green Bag, the consumer is entitled to dissolve the agreement.

4. The Little Green Bag reserves the right to refuse (partial) orders without stating reasons, to cancel them or to attach additional conditions to them, for example in the event of suspected abuse, errors in the offer, limited stock, previous payment problems or when the delivery address does not seem reliable. 5. Offers or promotions may have a limited validity period, which is explicitly stated. The Little Green Bag is not obliged to honour offers after the expiry of that period.

6. If an order contains multiple products with different delivery times, The Little Green Bag may decide to send the order in parts. No additional shipping costs will be charged for this, unless expressly agreed otherwise.

7. The Little Green Bag takes appropriate technical and organisational measures to guarantee the security of electronic transactions and personal data. When paying via the webshop, only certified and secure payment systems are used.

8. The Little Green Bag will provide the following information on a durable data carrier at the latest upon delivery of the product: – the business address of The Little Green Bag and the contact details of the customer service; – the conditions under which the consumer can exercise the right of withdrawal or a clear statement if this is excluded; – information about any guarantees, after-sales and complaint handling; – the total price including taxes, shipping costs and the chosen payment method; – if applicable, the model withdrawal form. 9. The Little Green Bag reserves the right to immediately terminate the agreement or suspend further deliveries in the event of indications of fraud, abuse of rights or other irregularities that may cause damage to The Little Green Bag or third parties.

Article 5 Prices & payment

1. All prices stated on the website and in other communications from The Little Green Bag include VAT and exclude any shipping and transaction costs, unless stated otherwise. Any additional costs will be clearly communicated to the consumer before completing the order.

2. The Little Green Bag reserves the right to change prices, in particular when this is necessary based on legal regulations or market conditions. Price changes do not affect agreements that have already been concluded.

3. Obvious errors or inaccuracies in price statements, for example as a result of technical malfunctions or input errors, can also be corrected by The Little Green Bag after the agreement has been concluded. In that case, the consumer has the right to cancel the order free of charge. 4. Payment must be made via one of the payment methods offered on the website of The Little Green Bag. The order will only be processed once payment has been successfully completed or authorized, unless a deferred payment method has been chosen (such as Riverty).

5. When using a payment method via an external payment provider (such as MultiSafepay, Buckaroo or Riverty), the terms and conditions of the relevant provider also apply. The Little Green Bag is not liable for delays or rejection of payments by third parties.

6. If payment has been chosen afterwards, a credit check may take place. The Little Green Bag and/or the payment partner reserves the right to refuse an order or to impose additional conditions, such as prepayment or a deposit.

7. The consumer has the obligation to report any inaccuracies in the payment details provided to The Little Green Bag without delay.

8. If a payment fails or is reversed, and the order has already been shipped, The Little Green Bag is entitled to suspend further deliveries or charge additional costs. In the event of non-payment, the claim may be transferred to a collection agency.

9. In the event of late payment, the consumer shall owe statutory interest without further notice of default. Reasonable extrajudicial collection costs may also be charged in accordance with the Decree on compensation for extrajudicial collection costs.

Article 6 Delivery & execution

1. The Little Green Bag does its utmost to process and ship orders as quickly as possible. Orders placed and paid for on working days before the specified time are usually shipped the same day. These delivery times are indicative and do not constitute a fatal term.

2. If a product is temporarily out of stock or cannot be delivered, the consumer will be informed of this as soon as possible. In that case, the consumer has the choice to cancel the order or to wait for subsequent delivery, unless the item is definitively unavailable.

3. Delivery takes place at the address specified by the consumer when ordering. The Little Green Bag is not liable for errors in the specified delivery address.

4. The risk of damage or loss of products rests with The Little Green Bag until the moment of delivery to the consumer or a pre-designated third party. From that moment on, the risk passes to the consumer.

5. The Little Green Bag is entitled to carry out the delivery in parts, provided that this is reasonably necessary. Partial deliveries are free of charge for the consumer, unless expressly agreed otherwise.

6. If delivery within the agreed period proves impossible, for example due to force majeure or delays at delivery partners, the consumer will be informed of this in good time. The Little Green Bag is not liable for consequential damage as a result of delay, unless there is intent or gross negligence.

7. If a delivery is refused without valid reason or is not collected at the collection point within the storage period, The Little Green Bag has the right to charge return costs and administration costs or to terminate the agreement.

8. If The Little Green Bag does not deliver on time, the consumer has the right to terminate the agreement without costs, provided that The Little Green Bag has been given a reasonable period after notice of default to still deliver and has not succeeded in doing so.

Article 7 Right of withdrawal & returns

1. The consumer has the right to revoke an agreement regarding the purchase of a product within a period of 30 days without giving reasons. This cooling-off period commences on the day on which the product is received by or on behalf of the consumer.

2. During the cooling-off period, the consumer must handle the product and packaging with care. The product may only be unpacked and used to the extent necessary to determine its nature, characteristics and functioning, as would be permitted in a physical store. If the product has been used or damaged further, depreciation may be charged.

3. The withdrawal must be reported in writing or via the returns portal of The Little Green Bag within the cooling-off period. The return form or the European model form may be used for this, but is not mandatory.

4. After the withdrawal, the consumer has a maximum of 14 days to return the product. The product must be returned - if reasonably possible - unworn, undamaged, in its original condition and with labels and packaging.

5. The costs for return shipment are for the account of the consumer, unless expressly stated or agreed otherwise. If The Little Green Bag bears the return costs, this will be clearly indicated. 6. Exclusion of the right of withdrawal is only permitted for products that: – are sealed for hygiene reasons and of which the seal has been broken after delivery; – are custom-made or personalized; – are clearly of a personal nature; – can spoil or age quickly; – are irreversibly mixed with other products after delivery due to their nature. If the right of withdrawal is excluded for an item, this will be clearly stated with the product.

7. In the event of a correct withdrawal, The Little Green Bag will refund the full purchase price, including any standard shipping costs, within 14 days of receipt of the withdrawal notification, provided that the product has actually been returned or the consumer has demonstrated that it has been sent.

8. The refund will be made via the same payment method as the original payment was made, unless otherwise agreed. No costs will be charged for the refund.

9. If the consumer has opted for a more expensive delivery and/or payment method than the standard option when purchasing, The Little Green Bag is not obliged to refund the additional costs.

Article 8 Guarantees & Liability

1. The Little Green Bag guarantees that the delivered products comply with the agreement, the specifications stated in the offer, reasonable requirements of soundness and usability, and the existing legal provisions at the time of delivery.

2. The legal guarantee applies to all articles. This means that a product must meet what the consumer can reasonably expect from it. Additional factory or brand guarantees do not affect these legal rights.

3. Damage caused by wear and tear, incorrect or intensive use, failure to follow instructions for use, external influences or own repairs is not eligible for the guarantee. The burden of proof that the defect is covered by the guarantee lies with the consumer.

4. If a product becomes defective within the guarantee period and this is covered, The Little Green Bag will repair the article free of charge, replace it or - if this is not possible - refund the purchase price. This takes into account normal use and depreciation of the product. 5. Complaints about defects in the product must be reported within a reasonable time after discovery. A report within two months after discovery is in any case considered timely.

6. The Little Green Bag is not liable for damage that has arisen as a result of incorrect use of the product by the consumer or third parties, unless there is intent or gross negligence on the part of The Little Green Bag.

7. Any liability of The Little Green Bag is limited to the amount that the consumer has actually paid for the product in question. The Little Green Bag is never liable for consequential damage, loss of profit, missed savings or other indirect damage.

8. If The Little Green Bag is held liable, the liability will at all times be limited to the amount that is paid out by the liability insurer in the relevant case, plus the applicable deductible.

Article 9 Complaints procedure

1. The Little Green Bag does everything it can to satisfy its customers. Should there be a complaint about a product, delivery or our service, you can report this via the contact form on our website.

2. Complaints must be submitted fully and clearly described within a reasonable period after the problem has arisen.

Complaints submitted later may be rejected if this prevents a proper assessment or handling.

3. After receiving the complaint, The Little Green Bag will send a confirmation of receipt within 3 working days and we will strive to respond substantively within 10 working days. If a complaint requires a longer processing time, you will be informed of this in good time.

4. The consumer must give The Little Green Bag a reasonable period to resolve the complaint by mutual agreement. Only if that period has expired without a satisfactory solution will a dispute arise that is eligible for further processing.

Article 10 Force Majeure

1. In the event of force majeure, The Little Green Bag's obligations will be suspended. Force majeure is understood to mean any external cause that is reasonably beyond the control of The Little Green Bag, which makes compliance temporarily or permanently impossible.

2. Force majeure includes in any case: strikes, disruptions, fire, government measures, pandemics, transport problems, import or export bans and shortcomings of suppliers of The Little Green Bag.

3. If the force majeure lasts longer than 30 days, both The Little Green Bag and the consumer have the right to terminate the agreement in writing, without the right to compensation.

Article 11 Intellectual property

1. All intellectual property rights relating to the name, corporate identity, logos, images, texts, videos, product descriptions and other content of The Little Green Bag are vested in The Little Green Bag or its licensors.

2. It is not permitted to publish, reproduce, modify or commercially exploit (parts of) the website or other content in any way without prior written permission from The Little Green Bag.

3. Infringement of these rights may lead to civil and/or criminal measures, including compensation and immediate removal of the infringing material.

Article 12 Privacy & data protection

1. The Little Green Bag respects the privacy of its customers and processes personal data in accordance with the General Data Protection Regulation (GDPR).

2. Personal data are collected and used exclusively for the execution of orders, the provision of customer service, marketing purposes (if permission has been given) and the improvement of the service. 3. The Little Green Bag only provides personal data to third parties to the extent necessary for the performance of the agreement (such as delivery services and payment providers) or when it is legally obliged to do so.

Article 13 Loyalty program (Baggies)

1. The Little Green Bag offers customers the opportunity to participate in the loyalty program 'Baggies'. Participation is free and linked to a personal account.

2. Baggies points can be saved with every purchase via the webshop or in the physical stores, unless stated otherwise. The exact savings conditions and redemption options are stated on the website and may change periodically.

3. Saved points can only be exchanged for discounts or other rewards as indicated within the account and cannot be exchanged for cash. Baggies are personal, non-transferable and can only be used by the registered user.

4. If an order is (partially) cancelled or returned, the associated Baggies will be corrected or withdrawn. In case of abuse or suspicion thereof, The Little Green Bag reserves the right to block the account or to declare accrued points invalid.

5. Baggies points have a limited validity period. Points automatically expire 12 months after receipt, unless otherwise stated. Expired points cannot be restored.

6. The Little Green Bag reserves the right to change, suspend or terminate the loyalty program at any time, whereby accrued points may expire with reasonable observance of a transition period.

Article 14 Discount codes & promotions

1. The Little Green Bag can offer temporary promotions or discount codes. The conditions of these promotions are always stated separately and are only valid within the specified period and under the stated conditions.

2. Discount codes cannot be exchanged for money and may only be used once, unless otherwise stated. Combining multiple discount codes in one order is not permitted.

3. Discount promotions do not apply retroactively and do not apply to orders already placed or previously discounted items, unless otherwise stated.

4. In the case of returns where a discount code has been used, only the actual amount paid will be refunded. The discount used will expire in that case and will not be awarded again.

5. The Little Green Bag reserves the right to change discount codes or promotions, terminate them prematurely or declare them invalid in the event of misuse, technical errors or other unforeseen circumstances.

Article 15 Applicable law

1. All agreements between The Little Green Bag and the consumer are exclusively governed by British law, regardless of the country from which the order is placed or delivered. The applicability of the Vienna Sales Convention is expressly excluded.

2. Disputes between the consumer and The Little Green Bag regarding the conclusion or execution of agreements can be submitted to the competent court in Rotterdam, unless mandatory law prescribes otherwise.

3. The Little Green Bag strives to resolve disputes as much as possible through mutual consultation.

Article 16 Final provisions

1. The Little Green Bag reserves the right to change or supplement these general terms and conditions at any time. The most current version can always be consulted via www.thelittlegreenbag.co.uk/gdpr-uk.

2. If a consumer places a new order after the conditions have been changed, the version of the general terms and conditions that was in force at the time of ordering will apply. 3. If any provision in these terms and conditions proves to be invalid or unenforceable in whole or in part, the remaining provisions will remain in full force. In that case, a new provision will take its place that approximates the purpose and scope of the original provision as closely as possible.

4. In the event of translations of these general terms and conditions, the Dutch text will always be leading for the interpretation and application thereof.
